These Terms explain how Moxy Web Studio provides website previews, website builds, hosting/care, and domain help for Moxy Web Studio customers.
By ordering from us, clicking to pay, approving a proof, or using a site we deliver, you agree to these Terms.
1. Who we are
Moxy Web Studio
Moxy Solutions, #2044, 207 W Millbrook Road, Suite 210, Raleigh, NC 27609
Contact: hello@moxywebstudio.com
We build simple websites for local small businesses. We may use AI tools and human review to prepare drafts, layouts, text, images, code, previews, and support responses.
2. What we sell
We offer three plans. Prices are shown on your private order page and at checkout.
Plan A — redesign only, you host it
For a customer who already has web hosting and wants the finished website files.
What you receive:
- the finished website as a zip file;
- written upload instructions;
- a download link for the period stated at checkout; and
- no hosting from us.
Important limits:
- installing the website on your own host is your responsibility;
- we do not log into your hosting account;
- we do not troubleshoot your hosting, builder, DNS, server, plugins, file manager, FTP, email, or third-party account;
- we may provide one short written hand-off reply if you have a basic question about the zip; and
- once the finished site is delivered, the Plan A payment is not refundable.
Plan A is not suitable if your current site is locked inside a website builder that cannot accept a static zip hand-off, such as Wix, Squarespace, Shopify, GoDaddy Website Builder, or a similar hosted builder. In that case, choose a hosted plan instead.
Plan B — redesign plus hosting on your domain
For a customer who already owns a domain name and wants us to host the site.
What you receive:
- the website build;
- hosting and SSL;
- daily backups;
- uptime monitoring;
- a working contact form;
- two small text or image changes per month; and
- a temporary address when the site is ready, followed by your own domain after DNS is pointed correctly.
Domain/DNS rule:
- you keep your registrar account;
- we do not ask for or take your registrar login;
- we do not take over nameservers;
- we give you the A records to point at us; and
- you or your registrar/DNS provider are responsible for placing those records unless we separately agree to guide you.
Email rule:
- we do not provide email mailboxes;
- we do not move your email hosting;
- do not cancel your old host or email service until you know where your email lives; and
- at setup, we may add or provide the records needed to keep your existing email provider working.
Care plan:
- hosting and care are billed monthly after the initial build payment;
- two small text or image changes per month are included;
- unused monthly changes do not roll over unless stated otherwise at checkout;
- larger edits, new pages, redesigns, new features, third-party integrations, copywriting projects, and emergency work may require a separate quote.
Plan C — new website plus domain plus hosting
For a customer who does not yet have a domain or website.
What you receive:
- the website build;
- hosting and SSL;
- daily backups;
- uptime monitoring;
- a working contact form;
- two small text or image changes per month; and
- domain registration through our Porkbun account, if the domain is available.
Domain ownership and transfer:
- the domain is for your business;
- we register it in our account for setup and management;
- we enable privacy when available;
- we will transfer it to you on request, subject to registrar rules, transfer locks, and unpaid balances;
- you must provide a destination registrar account and cooperate with the transfer process;
- if you cancel, we provide the transfer code or transfer path when available; and
- domain renewal continues only while your account is in good standing.
Email rule:
- we do not provide email mailboxes;
- if you need email at your domain, you must use a separate email provider;
- at setup, we may add your email provider's DNS records once, but we do not operate your mailbox.
3. Your responsibilities
You agree to:
- give us accurate business information, contact details, services, menu, pricing, hours, policies, photos, logos, and domain preferences;
- confirm that you have the right to give us the photos, logos, text, names, marks, and other materials you upload or request that we use;
- review proofs carefully before approving them;
- tell us promptly about corrections, legal restrictions, industry rules, licensing rules, accessibility needs, privacy needs, or claims that require special wording;
- keep your email, registrar, payment, and third-party accounts active and current;
- not upload unlawful, infringing, abusive, deceptive, private, sensitive, or regulated material unless we have expressly agreed in writing that it can be handled; and
- not use our site or forms to collect sensitive personal information unless that use has been reviewed and approved.
4. Customer content, photos, logos, and Google listing photos
You keep ownership of content you provide to us.
You give us permission to use, copy, resize, edit, store, display, and publish that content as needed to build, revise, host, deliver, support, and show your website.
If you upload photos or logos, you represent that you own them or have permission to use them for your business website.
If you choose to import photos from your Google listing, we import only photos that appear to be uploaded by your business or attributed to your business. We do not intentionally import reviewer/customer photos. We import those photos only after you ask us to use them.
Logo concepts we create are starter website graphics, not trademark searches, not trademark clearance, and not a promise that the logo is legally available. You are responsible for trademark review before treating a logo as a brand asset.
5. Website copy and business claims
We may draft plain-language copy from your information, your existing site, your Google business profile, and other verified sources.
You are responsible for checking that all claims on your site are true, current, licensed, permitted in your industry, and not misleading. This includes claims about prices, services, credentials, guarantees, health, legal, financial, before/after results, reviews, testimonials, safety, availability, and response times.
We do not provide legal, tax, medical, financial, advertising, professional-licensing, accessibility, or industry-regulatory advice.
6. Previews, proofs, approvals, and changes
Previews are drafts. They may be one-page, time-limited, noindex, and not fully functional.
A final proof is your chance to check the finished site before launch, zip delivery, or hosted deployment.
When you approve a proof, you are telling us that the site is ready to deliver or take live, subject to payment, DNS, domain, hosting, and technical constraints.
For hosted plans, the care plan includes two small text or image changes per month. A small change means a quick edit to existing content or an image swap. It does not include a new page, a redesign, new features, custom integrations, large copywriting, heavy troubleshooting, or third-party account work unless we separately agree.
7. Payments and billing
Payment terms, charges, recurring charges, taxes, and renewal amounts are the ones shown on your order page and at checkout.
Card details are handled by our payment processor and are not stored on our servers.
You authorize any one-time, monthly, annual, renewal, tax, or approved add-on charges shown at checkout or later approved by you.
If a payment fails, we may pause work, pause hosting, delay launch, withhold new changes, or require payment before continuing. We will give reasonable notice before taking down a live hosted site unless there is a security, abuse, legal, or emergency reason.
8. Taxes
Taxes are added where the law requires them and are shown at checkout.
9. Cancellation
Plan A cannot be cancelled for a refund after the finished zip has been delivered.
For hosted Plans B and C, you may cancel the hosting/care plan as described in the Refund and Cancellation Policy. On cancellation, we provide a zip copy of your site. For Plan C, we also provide the domain transfer path if the domain is eligible for transfer and your account is in good standing.
We may cancel or suspend service if you do not pay, misuse the service, ask us to publish unlawful or infringing content, create security risk, threaten or abuse staff/agents, or ask us to do work outside our approved scope.
10. Domains and DNS
For existing customer domains, our rule is A records only. We do not take registrar logins and we do not take over nameservers.
For new domains registered under Plan C, the domain is registered in our Porkbun account for setup and management. You may request transfer to your own registrar account. Transfer may be delayed by registrar locks, missing information, disputes, unpaid balances, or registrar rules.
We are not responsible for outages, delays, loss, renewal failure, DNS mistakes, email interruption, third-party registrar issues, or domain disputes caused by customer action, third-party systems, unpaid invoices, or inaccurate information, except to the extent applicable law does not allow that limit.
11. Email
We provide websites, not email mailboxes.
We do not promise to create, host, administer, troubleshoot, or migrate your email. If your website move affects DNS, you are responsible for making sure email records stay correct. We may help place your email provider's records once at setup, but your email provider remains responsible for the mailbox service.
12. Support
Support is limited to the scope of your plan.
Support may be provided by email, support desk, order-page chat, or an AI receptionist. The AI receptionist may collect information, record change requests, and route support needs, but it cannot approve refunds, disputes, legal terms, pricing exceptions, dates, or custom promises.
13. Third-party services
Our work may involve third-party services, including Stripe, Resend, Porkbun, Google services, hosting infrastructure, DNS providers, AI tools, and other software or vendors.
Those services have their own terms, privacy practices, uptime, outages, limits, and fees. We are not responsible for third-party service failures except where applicable law does not allow that limit.
14. No guarantees
We do not promise that your website will produce leads, sales, search rankings, reviews, traffic, revenue, conversions, ad performance, or business results.
We aim to provide a professional site and reasonable hosting/care within the scope of the plan, but the internet, DNS, third-party services, and customer-provided materials can create delays or problems.
15. Acceptable use
You may not use the service for unlawful, harmful, deceptive, abusive, infringing, spam, malware, harassment, regulated, adult, gambling, financial, medical, legal, or high-risk uses unless we expressly agree in writing and appropriate review is completed.
16. Limitation of liability
To the fullest extent allowed by law, our total liability for a claim related to the service will not exceed the amount you paid us for the specific service giving rise to the claim during the twelve months before the claim, and we are not liable for indirect, incidental, special, consequential, lost-profit, lost-revenue, lost-data, lost-goodwill, or business-interruption damages.
17. Indemnity
You are responsible for claims, losses, and expenses caused by materials you provide, instructions you give, claims you approve, your business operations, your legal/regulatory duties, your third-party accounts, your misuse of the service, or your breach of these Terms.
18. Changes to these Terms
We may update these Terms. The version posted at the time of your order or renewal applies unless a later version is required by law or you agree to updated terms.
